USPTO Extension Filing

Need More Time?
File an Extension.

If you’re not ready to submit proof of use yet, an extension can keep your trademark application active while you prepare.

Extensions are typically used when you haven’t started selling under the mark yet, or you need more time to gather acceptable proof of use (like packaging, labels, or a live product page).

What an extension helps with

  • Prevents your application from stalling while you get ready to submit proof of use.
  • Gives you time to launch, ship, or finalize branding materials for compliant evidence.
  • Keeps your filing timeline on track so you don’t miss critical windows.

If you’re already using the mark in commerce, you may be able to file proof of use instead of an extension.
